Kenya-Uganda Agencies in Bid for Corporation to Tackle Trade in Counterfeit Trade

Kenya’s Anti-Counterfeit Agency- and Ugandan Anti-Counterfeit Network (ACN) Africa held a meeting today “to exchange ideas on how better to improve collaboration in the fight against counterfeit trade with a major call for regional cooperation to tackle the problem”. ACN is a not-for-profit registered entity in Uganda that aims to bridge the intervention gaps between the multiple stakeholders that affect and are being affected by counterfeits and illicit trade.

Partnership with NITA to develop Training of Trainers Curriculum and Training Manual

The Anti-Counterfeit Authority has partnered with the National Industrial Training Authority to develop a Training curriculum on Intellectual Property enforcement. A first of its kind in matters counterfeiting that emanates from infringement of IP in Kenya will be available to all IP enforcement stakeholders in the country and is open to our counterparts in the region.

The need for education on matters counterfeiting and intellectual property is no longer limited to academic institutions or specialist IP practitioners but open to business executives, government agencies dealing with IP and non-jurists interacting with the IP ecosystem. Despite these academic institutions offering IP, IP education is relatively new to many, and principles and methods in teaching IP are still evolving.

The Anti-Counterfeit Authority yesterday impounded more than 10,000 bags of 50kg bags of counterfeit Rice valued at Ksh.40 Million at a go-down in Shimanzi area at the Kenyan sea port city of Mombasa. Investigations are underway to establish the particulars of the importer and the other outlets involved in the trade.

IPR Recording Rules a Key Weapon in Counterfeits Battle

Kenya has made significant progress in the war against counterfeit goods, with a robust multi-agency approach being implemented, and a raft of legislation to ensure fake products do not impede the country’s development progress.

Despite these achievements, several problems still exist. These include the Anti-Counterfeit Authority's (ACA) prior operations being more reactive than proactive due to inadequate intelligence on the counterfeit industry. This has made monitoring of commodities difficult, together with border porosity and the rising volume of e-commerce.

Anti-Counterfeit Authority Eyes a Plan to Partner with eCommerce Platforms to Weed Out Online Counterfeiting

The Anti-Counterfeit Authority is touting a plan to partner with Kenya’s Digital Markets to ensure that the e-commerce platforms are not conduits of counterfeiting. The plan is to have online platform owners evaluate their vendor base to ensure that they meet certain requirements to weed out rogue sellers who trade in counterfeits.

Counterfeit Motor Vehicle Engine Oil Trade Busted in Busia Kenya - Uganda Border Town

Anti-Counterfeit Inspectors raided a motor vehicle and engine oil outlet in the Kenya-Uganda border town of Busia and seized counterfeit motor vehicle engine oil that was packaged and ready for sale. The container and their labels were designed to pass off and confuse consumers to buy thinking they belonged to those of a popular motor vehicle engine oil brand.

 Anti-Counterfeit Authority Names Dr. Robi Mbugua Njoroge as Executive Director and Chief Executive Officer

 Dr. Mbugua will take charge of the organization tasked with the mandate of combating counterfeit trade in Kenya. He will spearhead and coordinate government efforts in the protection and promotion of Intellectual Property rights.

 Nairobi, August 1, 2022.  

The Anti-Counterfeit Authority Board has appointed Dr. Mbugua Njoroge as the new Executive Director to succeed Ms. Fridah Kaberia who leaves the Authority after serving for two years in an Acting capacity. The appointment takes effect from August 1, 2022. Dr. Njoroge joins the Authority from the Kenya Association of Music Producers (KAMP) where he served as the Chief Executive Officer.

A multi-agency team in Matuu sub-county in Machakos waylay a van carrying a consignment of illicit liquor following a tip-off.

A raid by Multi-agency enforcement team dealing with illicit trade intercepted a motor vehicle registration number KCY 596D and found 220 Boxes containing 4400 bottles of counterfeit alcoholic drinks of known Kenyan brands in Matuu town, Machakos County. The alcohol approximated to be worth Ksh 880,000.00 and the vehicles were seized and booked at the Matuu Police station. The driver was arrested and is assisting officers with investigations.

ACA Hosts visiting US Customs and Border Control Protection Deputy Assistant Commissioner for International Affairs

The Anti-Counterfeit Authority played host to the US CBP Deputy Assistant Commissioner for International Affairs Mr. Clint Lamm at the sidelines of the World Anti-Counterfeit Day commemorations at the Crown Plaza Hotel Nairobi. Mr. Lamm was accompanied by Mr. Anthony Baccari, the CBP Director Africa, Middle East & Asia, Mr. Benito Montiel Senior Advisor of the CBP Security Governance Initiative, and Mr. Harrison Koech the CBP Program Manager Kenya. The team was hosted by the Chairperson of the Board of Directors Ms. Flora Mutahi together with the Senior Management team of the Authority led by the Acting Executive Director Ms. Fridah Kaberia.

Businesswoman fined KSH 3,000,000.00 or in default sentenced to 4 Years in Prison for selling counterfeit Circuit breakers

Nairobi, 17th June 2022,

A Nairobi woman Ms. Rose Nyambura was found guilty for importing into the country counterfeit goods by a Nairobi City Court. In delivering the sentence, Hon. G. Onsaringo ordered the defendant to pay a Khs 3,000,000.00 fine or in default to serve four (4) years in prison, noting that the crime she was convicted of posed a great danger to consumer health and safety.

Anti-Counterfeit Authority Marks World Anti-Counterfeit Day with Launch of Intellectual Property Recordation for Imports to curb the growth of counterfeit trade

The Anti-Counterfeit Authority (ACA) today joined the rest of the world in commemoration of the World Anti-Counterfeit Da. The day is globally organized by the Global Anti-Counterfeiting Group (GACG) - an international network of national and regional IPR enforcement and protection organizations. In Africa, Kenya is the only member of the GACG through the Anti-Counterfeit Authority from East Africa, besides Nigeria and Zimbabwe.

Kenya, a member of the Global Anti-Counterfeit Group through the Anti-Counterfeit Authority, will join the rest of the world in marking the World Anti-Counterfeit Day (WACD) on June 15th, 2022.

The globally commemorated day takes stock of the global efforts in combatting counterfeiting, which is one of the biggest threats to an economy with adverse impact on revenue collection.

World Anti-Counterfeit Day 2022 Stakeholder Sensitization Forums in partnership with County Government of Machakos.

As a precursor to the commemoration of the World Anti-Counterfeit Day, the Anti-Counterfeit Authority partnered with the County Government of Machakos in a series of public outreach activities. The first activity held at the Machakos International Convention Centre brought together County & National Government Officers in sensitization forum followed by the county business community sensitization forum at the Semara Hotel in Machakos the next day. 

 Announcement of Mr. Yussuf Osman as Director of Enforcement Directorate

 

Mr. Osman will provide strategic leadership to the core directorate of enforcement and oversee more than 100 Inspectors and branches country-wide.

The Anti-Counterfeit Authority has announced the appointment of one Mr. Yussuf Osman Ahmed as the new Director of the Enforcement Directorate. The appointment was made after a successful interview and will take over his new role immediately.

Mr. Osman has a vast Experience in law enforcement and leadership having worked with the Anti-Cou8nterfeit Authority for more than 12 years.). His career is checkered in Consumer protection and intellectual Property Right Enforcement for over twenty-years (20Years) He started as an Investigating Officer and Prosecutor with the Weights and Measures Department under Ministry of Trade and Industry in the year 2000.

Before, his current appointment, Mr. Osman has worked with the Anti Counterfeit Authority in various ranks. He stated at entry level as Anti- Counterfeit Inspector II in 2010 and rose through the ranks to become Regional Manager Eldoret in 2016 and later the Regional Manager, Mombasa in 2018 where he was in in charge of the coast region including the Port of Mombasa and the Lunga Lunga Border. He was responsible for regional supervision of staff and enforcement activities as well as stakeholder relationship working closely with other Law enforcement agencies under the muilti-agency framework against illicit trade in the region.

  

“Osman Brings a wealth of experience to his new role of providing strategic leadership in managing the core function of the Enforcement Directorate. His key responsibility will be to spearhead and coordinate the enforcement function of the Authority in respect to the protection of Intellectual Property among other duties" said Acting Executive Director Ms. Fridah Kaberia in a circular to staff of the Authority. 

His appointment comes in the wake of renewed government efforts in the war against illicit trade with the government establishing Multi-Agency Anti-Illicit Trade Working groups from government agencies tasked with fighting illicit trade. Mr. Osman will play a key role in promoting the inter-agency collaboration in policy implementation and operational coordination in the fight against counterfeit trade and illicit trade in the country.

Extension of Deadline: Commencement of Recordation of Intellectual Property Rights in Kenya

In this regard, we hereby announce the EXTENSION OF THE DEADLINE for the commencement of section 34B of the Anti-Counterfeit Act, Legal Notice No. 117 of 2021 and Legal Notice No.118 of 2021 by six (6) months from 1st July 2022 to 1st January 2023

Motorcycle Assembling Plant Raided and 54 Counterfeit Boda Bodas Seized

Kisumu, 18th May 2022. 

The Anti-Counterfeit Authority Inspectors busted a motorbike assembling go-down and shop in Homabay Town and seized 54 suspected counterfeit Motorcycles worth Ksh. 7,020,000. The go-down and shop identified as Ndisimart Enterprises Ltd was assembling motorcycles going by the trademark counterfeit Bajaj Boxer which were passed off as original to unsuspecting customers. 

The raid followed a complaint lodged by Mr. Paul Ramara of Spoors and Fischer Law firm the Agents of the Indian origin brand of motorbikes. Upon receipt of his complaint that was made in the Kisumu Regional office, the ACA Inspectors raided the premises and managed to confirm the allegations. Mr. Ramara clarified that ‘All Bajaj Boxer Motorbikes are made in India as opposed to China as in this case’.   

Commencement of Recordation of Intellectual Property Rights in Kenya

The Anti-Counterfeit Authority hereby announces the commencement of Recordation of Intellectual Property Rights (IPR) through the Anti-Counterfeit Authority Integrated Management System (“AIMS”) via the link ACA Public System (public.aims.aca.go.ke).
IPR Recordation involves the creation of a database of IPR information relating to trademarks, copyrights, trade names, or any other protected intellectual property rights, for all goods to be imported into Kenya.

This information is made available on the  ACA Public System and shall be used by ACA inspectors and other law enforcement officers at the various points of entry to prevent entry of counterfeit imports into Kenya.

The World IP Day 2022  

The World Intellectual Property Organization (WIPO) has made an announcement that this year’s World IP Day will be observed on April 26. The theme of the Day will be “IP and Youth: Innovating for a Better Future” in celebration of how young people are stepping up to innovation challenges while creating a sustainable future. “Young people using their energy, ingenuity, curiosity, and creativity to meet innovation challenge” reads the announcement. 

ACA Partners with KBC TV and Coro FM for Mount Kenya Region Road Show

Nyeri, 26th February 2022. 

The public awareness team from the Authority together with CORO FM News crew and KBC TV co-organized a two-day Roadshow targeting the Mt. Kenya Region that coincided with the planting season in the region.  

The Anti-Counterfeit Authority Deputy Director in charge of Public Awareness, Mrs. Agnes Karingu said the Authority had resulted to using vernacular radio stations towards creating awareness to small-scale farmers. "This is strategic communication to reach as many farmers as possible to educate them on how to avoid buying counterfeit Agro-inputs to improve their farming outcomes". She spoke.

Christmas and new year festivities provide an opportunity for families and friends to come together. They are occasions when families exchange gifts, purchase a variety of items for domestic use and for get-together parties. People generally visit supermarkets, shopping malls and other retail outlets to buy products of their choice. The volume of goods purchased and consumed peaks during this period. Immediately after the new year festivities, children return to school and parents once again engage in purchase of various return-to-school items such as textbooks and other forms of stationery. 

Demand for fast moving goods is always at its highest peak during this holiday season. With increased demand, there is the usual necessity to supply goods to meet the demand. Counterfeiters take advantage of the heightened demand to fill the gap by supplying counterfeit goods in the market. This is therefore a critical time for all of us to be extra vigilant not to fall prey to the purchase and consumption of counterfeit goods.
