ACA and Office of the Director of Public Prosecutions Strengthen Collaboration to Enhance Prosecution of Counterfeit Cases

The Anti-Counterfeit Authority (ACA) and the Office of the Director of Public Prosecutions (ODPP) to strengthen collaboration in the prosecution of counterfeiting crimes in Kenya.

This was affirmed today during a meeting between ACA and ODPP officials. 

Speaking during the meeting, Dr. Robi Mbugua Njoroge, ACA Executive Director, said, “successful prosecution of intellectual property crimes requires close collaboration between investigatory agencies and the prosecution arm of government. Strengthening our partnership with the ODPP will enhance the handling of IP cases and serve as a deterrent against counterfeit trade.”

“Counterfeiting is not just an economic crime - it poses a serious risk to public health, consumer safety and business growth. This collaboration with ACA will reinforce Kenya’s efforts to secure stronger legal action against offenders,” stated Mr. Renson M. Ingonga, OGW, the Director of Public Prosecutions.

The engagement, themed “Enhancing Partnerships and Collaboration” aimed at streamlining the prosecution of IP-related cases, capacity building for officers in the criminal justice system, leveraging research for data-driven enforcement, and intensifying public education on counterfeiting.

As the constitutionally mandated office for public prosecution, ODPP plays a crucial role in ensuring counterfeit-related offenses are prosecuted effectively. ACA leads government efforts in combating counterfeit trade through enforcement, public awareness and education, research, and policy development.

Key discussions focused on improving coordination between investigatory officers and prosecutors to ensure seamless prosecution of IP cases. Both institutions acknowledged the need for joint training programs to enhance the legal and investigative capabilities of officers handling IP crimes.

Additionally, ACA and ODPP committed to develop a structured roadmap to implement these collaborative initiatives, ensuring a more coordinated and effective approach to prosecuting IP-related offenses in Kenya. 

The renewed partnership is expected to increase the number of successful convictions, protect local and international brands, and bolster Kenya’s reputation as a safe and secure business environment.

ACA and ODPP reaffirm their unwavering commitment to ensuring intellectual property rights are upheld and that counterfeit-related crimes are decisively dealt with to safeguard public health, safety, and economic integrity. #Ends
